1. About these terms
This website, solian.co.ke (the “Website”), is owned and operated by Solian Limited (“Solian”, “we”, “us”, “our”), a limited liability company incorporated in Kenya, with its registered office at Palm Breeze, Links Road, Mombasa.
By accessing, browsing or using the Website, you confirm that you have read, understood and agree to be bound by these Terms and Conditions and by our Privacy Policy. If you do not agree, please do not use the Website.
2. The Website is for information only
The Website is published for general information and marketing purposes. Nothing on the Website constitutes an offer capable of acceptance, and no content on the Website forms part of any contract.
Property descriptions, unit sizes, floor plans, site layouts, prices, payment plans, completion dates, amenities, finishes and availability are indicative only and may be varied or withdrawn by us at any time without notice. While we take reasonable care to keep information accurate and current, we do not warrant that any information on the Website is complete, accurate or up to date at the time you view it.
You should verify all material details directly with our sales team before making any decision or payment.
3. Images, renders and off-plan developments
Photographs, computer-generated images, artist’s impressions, videos, scale models and show units are for illustration only. They are not to scale, may show fittings, furniture, landscaping, finishes or surroundings that are not included in the sale, and may show a stage of development that has not yet been completed.
Where a unit or plot is offered off-plan, the specifications and projected completion dates represent our intention at the time of publication. They are subject to statutory approvals, contractor and supplier performance, site conditions, weather, availability of materials, changes in law and other matters outside our reasonable control, and may change. The binding specification and timeline are those set out in your signed sale agreement.
4. No investment, financial, legal or tax advice
Any reference on the Website to returns, return on investment, capital appreciation, rental yields, occupancy rates or growth potential is illustrative, based on assumptions stated or implied at the time of publication, and is not a guarantee, projection or promise of any financial outcome. Property values and rental income can fall as well as rise. Past performance of any Solian project is not an indicator of future performance.
Nothing on the Website constitutes investment, financial, legal, valuation or tax advice, and it does not take account of your personal circumstances. You should obtain independent advice from your own advocate, licensed valuer, tax adviser or financial adviser before committing to any purchase or investment.
5. Your transaction is governed by separate written agreements
Any purchase, reservation, lease or tenancy is governed exclusively by the written documents executed between you and Solian, including any reservation form, letter of offer, sale agreement, lease, tenancy agreement, transfer and completion documents.
In the event of any inconsistency between the Website and those executed documents, the executed documents prevail. No statement, image or price on the Website, and no communication from any employee, agent or marketer, creates a binding obligation on Solian unless and until it is recorded in a document signed by both parties and any required deposit has been paid in accordance with that document.
6. Enquiries, site visits and viewings
Submitting an enquiry form or a request to book a site visit is a request only. It does not reserve a unit, fix a price, or oblige us to confirm a visit. All visits are subject to confirmation and availability.
Our projects include active construction sites. If you attend a site visit you do so at your own risk, you must remain in the areas designated by our staff, comply with all safety instructions and protective equipment requirements, and supervise any minors in your party at all times.
7. Payments and fraud warning
Please read this section carefully.
All payments to Solian must be made only to bank accounts held in the name of Solian Limited as stated in your signed agreement or on an official Solian invoice or receipt.
- We will never ask you to change payment details by email, SMS, WhatsApp or social media message.
- We will never ask you to pay into a personal account, or into an account in the name of a staff member, agent or marketer.
- Before making any transfer, verify the account details by telephoning our offices on +254 711 082500 using the number published on this Website.
We accept no liability for any payment made to an account that has not been confirmed through our official channels, or for any loss arising from your failure to verify payment instructions.
8. Communications and consent to be contacted
When you submit an enquiry, request a site visit, download a brochure or subscribe to our newsletter, you consent to us contacting you by telephone, SMS, WhatsApp and email in connection with that request and with our properties and services.
You may withdraw your consent to marketing communications at any time using the unsubscribe link in our emails or by writing to enquiries@solian.co.ke. We may still contact you about an active transaction or a legal obligation after you opt out of marketing.
9. Careers and job applications
Vacancies posted on the Website are open only for the period stated. Submitting an application creates no obligation on us to consider, respond to or progress it, and we may close, amend or withdraw any vacancy at any time.
Solian does not charge any fee at any stage of recruitment. Any request for payment in connection with a Solian job application or interview is fraudulent and should be reported to us immediately.
10. Intellectual property
All content on the Website, including text, photographs, renders, videos, drawings, floor plans, brochures, newsletters, graphics, layout and source code, is owned by or licensed to Solian and is protected by the Copyright Act, 2001 and other applicable laws.
You may view, download and print Website content for your own personal, non-commercial use in evaluating our properties. You may not otherwise reproduce, republish, distribute, adapt, sell or commercially exploit any part of the Website without our prior written consent. Media and press may reproduce published material with clear attribution to Solian.
“Solian”, “Marijani by Solian”, our project names and our logos are our trade marks and may not be used without our written permission.
11. Acceptable use
You agree not to:
- use the Website for any unlawful or fraudulent purpose, or in breach of these terms;
- copy, scrape, harvest or systematically extract data, listings, images or contact details from the Website, whether manually or by automated means;
- introduce any virus, malware or other harmful code, or attempt to gain unauthorised access to the Website, its servers or any connected system;
- impersonate Solian, our staff or our agents, or misrepresent your affiliation with us;
- interfere with the proper operation of the Website or place an unreasonable load on our infrastructure.
Unauthorised access to or interference with the Website may constitute an offence under the Computer Misuse and Cybercrimes Act, 2018, and we will report and pursue such conduct.
12. Content you submit
Where the Website allows you to submit content, including comments, reviews, testimonials, photographs or job applications, you confirm that the content is accurate, is yours to share, and does not infringe any third party’s rights or breach any law.
You grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and publish that content in connection with our business, including in marketing materials, unless you tell us in writing that you do not wish us to do so. We may edit, decline to publish or remove any submitted content at our discretion.
13. Third-party links and embedded content
The Website contains links to, and embedded content from, third-party services including YouTube, social media platforms, mapping services and payment or financing partners. We do not control those services, we are not responsible for their content, security or practices, and a link does not imply endorsement. Your use of a third-party service is governed by that provider’s own terms and privacy policy.
14. Availability of the Website
We aim to keep the Website available, but we do not guarantee that it will be uninterrupted, timely, secure or error-free. We may suspend, withdraw, restrict or amend all or any part of the Website at any time without notice, including for maintenance, upgrades or security reasons.

To the fullest extent permitted by law, the Website and its content are provided “as is” and we exclude all warranties, conditions and representations, whether express or implied.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded, including under the Consumer Protection Act, 2012.

You agree to indemnify and hold Solian, its directors, employees and agents harmless against any claim, loss, liability, cost or expense (including reasonable legal fees) arising from your breach of these terms, your misuse of the Website, or any content you submit.

Our collection and use of personal data is described in our Privacy Policy, which forms part of these terms.
18. Complaints
If you have a complaint about the Website or about any dealing with Solian, please write to enquiries@solian.co.ke or call +254 711 082500. We will acknowledge your complaint and aim to respond substantively within 5 business days.
19. Changes to these terms
We may amend these terms from time to time. The version published on the Website at the time you use it is the version that applies. The “Last updated” date above shows when these terms were last revised. Material changes will be notified on the Website.
20. Severability and waiver
If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision is not a waiver of our right to enforce it later.
21. Governing law and dispute resolution
These terms, and any dispute arising out of or in connection with them or with your use of the Website, are governed by the laws of Kenya.
The parties shall first attempt in good faith to resolve any dispute by negotiation and, failing that, by mediation.
